    Healing the Physician’s Story: A Case Study in Narrative Medicine and End–of–Life Care.Lori A. Roscoe - 2012 - Narrative Inquiry in Bioethics 2 (1):65-72.
Telling stories after a loved one’s death helps surviving family members to find meaning in the experience and share perceptions about whether the death was consistent with the deceased person’s values and preferences. Opportunities for physicians to evaluate the experience of a patient’s death and to expose the ethical concerns that care for the dying often raises are rare. Narrative medicine is a theoretical perspective that provides tools to extend the benefits of storytelling and narrative sense–making to physicians. This case (...)

    In Search of a Good Death.David P. Schenck & Lori A. Roscoe - 2008 - Journal of Medical Humanities 30 (1):61-72.
Spirituality and storytelling can be resources in aging successfully and in dying well given the constraints of modern day Western culture. This paper explores the relationship of aging to time and the dynamic process of the life course and discusses issues related to confronting mortality, including suffering, finitude, spirituality, and spiritual closure in regard to death. And, finally, the role of narrative in this process is taken up.

    African Americans and Hospice Care: A Narrative Analysis.Patrick J. Dillon & Lori A. Roscoe - 2015 - Narrative Inquiry in Bioethics 5 (2):151-165.
Recent studies suggest that terminally ill African Americans’ care is generally more expensive and of lower quality than that of comparable non-Hispanic white patients. Scholars argue that increasing hospice enrollment among African Americans will help improve end-of-life care for this population, yet few studies have examined the experiences of African American patients and their loved ones after accessing hospice care. In this article, we explore how African American patients and lay caregivers evaluated their hospice experiences. Drawing from 39 in-depth interviews (...)

Social Signaling and the Warrior-Big-Man among the Western Dani.Paul Roscoe, Richard J. Chacon, Douglas Hayward & Yamilette Chacon - 2019 - Human Nature 30 (2):176-191.
We employ the Social Signaling Model and life history of a Western Dani big-man, Tibenuk, to analyze a neglected curiosity in the career of the big-man type. The big-man is renowned as an economic entrepreneur, the master of material displays. In New Guinea, however, big-men had invariably first gained fame and some influence as eminent warriors. The SSM accounts for this two-part career path by proposing that small-scale social organization rests on honest, competitive signaling of individual and collective fighting strength, (...)

Studies exploring how students learn and understand science processes such as diffusion and natural selection typically find that students provide misconceived explanations of how the patterns of such processes arise (such as why giraffes’ necks get longer over generations, or how ink dropped into water appears to “flow”). Instead of explaining the patterns of these processes as emerging from the collective interactions of all the agents (e.g., both the water and the ink molecules), students often explain the pattern as being (...)

Social Substitutability and the Emergence of War and Segmental, Multilevel Society.Paul Roscoe - 2023 - Human Nature 34 (4):621-643.
Raymond Kelly’s widely cited _Warless Societies and the Origin of War_ (University of Michigan Press, 2000) seeks to explain the origins of two central signatures of human society: war and segmented—i.e., multilevel—societies. Both, he argues, arose with the emergence of a social-substitutability principle, a rule that establishes a collective identity among a set of individuals such that any one member becomes equivalent to, and responsible for the actions of, the others. This principle emerged during the Holocene, when population increase gave (...)

Organizations as Spaces for Caring: A Case of an Anti-trafficking Organization in India.Roscoe Conan D’Souza & Ignasi Martí - 2022 - Journal of Business Ethics 177 (4):829-842.
Prior research has shown that human trafficking has multiple facets and is deeply enmeshed in societies around the world. Two central challenges for anti-trafficking organizations pertain to confronting systemic injustices and establishing caring organizations for survivors to start the process of healing and restoration. Analyzing the work of an anti-trafficking organization, International Sanctuary in Mumbai, we seek to elucidate how a space for caring for trafficking survivors is constructed in a largely non-egalitarian and unjust context. We contribute to discussions on (...)

This book is intended to challenge Frege's Begriffsschrift as the foundation of philosophical work which either uses formal methods or is inspired by them s it attempts the synthesis of the antithetical ideas associated with Wittgenstein, the Picture-Theory, and the language-game conceived as the untimate level of explanation.

The ideal element in law.Roscoe Pound - 1958 - Clark, N.J.: Lawbook Exchange.
Roscoe Pound, former dean of Harvard Law School, delivered a series of lectures at the University of Calcutta in 1948. In these lectures, he criticized virtually every modern mode of interpreting the law because he believed the administration of justice had lost its grounding and recourse to enduring ideals. Now published in the U.S. for the first time, Pound's lectures are collected in Liberty Fund's The Ideal Element in Law, Pound's most important contribution to the relationship between law and (...)

The Uncanny Self in Love: Divorced Catholic Women Remember Abortion in Romania.Marc Roscoe Loustau - 2018 - Journal of Religious Ethics 46 (1):63-87.
This essay presents an ethnographic account of two divorced Catholic women's memories of praying to the Virgin Mary while seeking illegal abortions under the Romanian socialist regime. These women's stories focused on troubling memories of being in love, reflections that were retrospectively shaped by divorce. Drawing on Sigmund Freud's notion of the uncanny, I call these recollections uncanny memories of the self in love. Uncannily remembering one's self in love combines experiential self-examination and ethical assessment of actions. The notion of (...)

The constitution, the courts and the common law.Robert A. Sedler - manuscript
This article maintains that it is the constitutional responsibility of the courts, here the courts of the State of Michigan, to engage in judicial policymaking in the process of formulating common law rules. The article is written in response to the views expressed by some Justices of the Michigan Supreme Court that separation of powers concerns should impose significant limits on the power of the courts to establish and develop the common law of Michigan. Specifically, the contention is that policymaking (...)

Reprint of Volume XVII in Probsthain's Oriental Series. With a Chinese index and an index of names and references. The Book of Lord Shang was probably compiled sometime between 359 and 338 BCE. Along with the Han Fei-Tzu, it is one of the two principal sources of Legalism, a school of Chinese political thought. Legalism asserts that human behavior must be controlled through written law rather than through ritual, custom or ethics because people are innately selfish and ignorant. The law (...)

Bruce Lincoln suggests that myth is "that small class of stories that possess both credibility and authority". When studying the history of mythology we find that myths often are understood as something other people have—as if the group in question possesses the truth while others live by falsehoods. In examining contemporary North American society, we can see how Judeo-Christian narratives structure popular and medical discourses regarding sex and gender. The idea that humans are born into male and female, and male (...)

"The Austin of the Jurisprudence of Administrative Law" This book originated as a series of lectures presented at Johns Hopkins in 1915. It proposes a method to supplement the established doctrine of constitutional law, which enforces legislative norms through negation and review, by a system of positive principles that would guide the making of statutes and give more definite meaning and content to the concept of due process. Highly regarded since its original publication in 1917 and the winner of Harvard (...)

Recent histories of American jurisprudence tend to ignore the fact that ideas that appeared in the United States often appeared simultaneously in Europe. Even those works that do not ignore the European context are content with tracing the influence or reception of European thought in America. This article suggests that another possible approach is to compare jurisprudential developments in the United States, Europe, and other places in order to reach more general, sociology-of-knowledge-like insights into the reasons why certain ideas appear (...)

    The Historiography of Late Nineteenth-Century American Legal History.David M. Rabban - 2003 - Theoretical Inquiries in Law 4 (2).
Although the treatment of history in late nineteenth-century American legal scholarship remains largely unexplored, two recent areas of research have discussed this subject tangentially. Historiographical critiques of the emphasis on doctrine by American legal historians typically maintain that late nineteenth-century legal scholars viewed history as disclosing an inevitable evolutionary progression from primitive to civilized forms. This "whiggish" approach, the critiques add, ignored the context and function of past law while apologetically justifying conservative existing law as autonomous scientific truth. Without addressing (...)
